These Terms of Service (“Terms”) apply to both our website (luckyplanetgames.com) and all our mobile games and applications (collectively, the “Services”) provided by Lucky Planet Games Inc. (“Company,” “we,” “us,” or “our”).
By accessing our website or by downloading, installing, accessing, or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Acceptance of Terms
These Terms form a legally binding agreement between you and Lucky Planet Games Inc. Your use of the Services is also subject to our Privacy Policy, which is incorporated by reference.
We may modify these Terms at any time. Continued use of the Services after changes constitutes your acceptance of the updated Terms.
2. Eligibility and Age Requirements
You must be at least 13 years of age to use any of our Services.
Additional Restrictions for Social Casino Games:
Our social casino-style games (including but not limited to scratch-off, slots, lottery-style, and other simulated gambling games) are intended for users who are 18 years of age or older. These games contain simulated gambling content and are not suitable for minors. You must be 18+ to download, install, or play any of our social casino games.
If you are between 13 and 17 years old, you may only use our non-casino casual games with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.
You accept full responsibility for any use of the Services by minors under your supervision or through your devices or payment methods. We reserve the right to block access or terminate accounts if we believe a user is underage.
You further represent and warrant that you are not: (a) located in or a resident of any country subject to a U.S. government embargo or sanctions; (b) listed on any U.S. government list of prohibited or restricted parties, including the OFAC list of Specially Designated Nationals; or (c) previously suspended or banned from the Services by Lucky Planet Games Inc. for any reason. You agree to comply with all applicable domestic and international export laws and regulations and may not transfer the Services to any embargoed country or prohibited party.
3. Electronic Communications
By using the Services, you consent to receive electronic communications from Lucky Planet Games Inc., including notices, agreements, disclosures, and other information, via email or through the Services. You agree that all such electronic communications satisfy any legal requirement that communications be in writing.
4. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your personal, non-commercial entertainment purposes.
The Services are licensed, not sold. We retain all ownership rights, title, and interest in the Services.
5. Virtual Currency and Virtual Items
Certain games may offer virtual currency, items, or other in-game content. These are provided solely for entertainment within the game and have no real-world monetary value.
We may modify, suspend, remove, or discontinue any virtual currency or items at any time without notice or liability.
6. No Real Money Rewards, Prizes, or Correlation to Real-World Gaming
Our games are provided strictly for entertainment purposes only. The Services do not offer any opportunity to win real money, cash, or anything of monetary value.
All virtual currency, virtual items, rewards, prizes, winnings, or other in-game benefits (collectively, “Virtual Rewards”) are fictional and have no real-world monetary value whatsoever. Virtual Rewards:
- Cannot be exchanged, redeemed, or converted into real money, cash, gift cards, or any other form of value outside the game;
- Do not represent or constitute any property, ownership interest, or legal claim;
- May be modified, reduced, removed, or discontinued by the Company at any time without notice or compensation;
- Do not create any expectation or right to receive real-world rewards or compensation.
Success in the games has no bearing on real-world gaming or gambling. Performance, skill, winning streaks, high scores, or any results achieved in our games do not indicate, predict, or have any correlation with success in real-world gambling, casinos, lotteries, or any other form of real-money gaming. The games are not intended as practice, training, or preparation for real-world gambling activities.
You acknowledge and agree that:
- You are playing the games solely for entertainment;
- You have no expectation of winning anything of real-world value;
- Skill or success in the games does not translate to or provide any advantage in real-world gaming or gambling;
- The Company makes no representations or warranties regarding the value, availability, or real-world relevance of any Virtual Rewards or game outcomes.
Any attempt to sell, trade, or transfer Virtual Rewards for real-world value is strictly prohibited and may result in immediate termination of your account and potential legal action.
7. In-App Purchases
All in-app purchases are processed by the applicable app store (Google Play, Apple App Store, or Amazon Appstore). Purchases are final and non-refundable except as required by law or the app store’s refund policy.
We are not responsible for billing, payment processing, or refund issues handled by third-party app stores.
We reserve the right to correct any errors, inaccuracies, or omissions in pricing or descriptions of virtual items at any time without prior notice, including after a purchase has been initiated.
8. User Accounts
You are solely responsible for maintaining the security of your account and all activity that occurs under it. We reserve the right to suspend or terminate any account at any time for any reason, including violation of these Terms.
9. User Conduct and License Restrictions
You agree that you will not:
- Use the Services for any illegal purpose or in violation of any law;
- Cheat, hack, use bots, exploits, automation, or any unauthorized third-party software;
- Harass, abuse, threaten, or harm other users;
- Post or transmit any content that is obscene, defamatory, hateful, or otherwise objectionable;
- Impersonate any person or entity;
- Attempt to gain unauthorized access to the Services or related systems;
- Interfere with, disrupt, or overburden the Services;
- Reverse engineer, decompile, or attempt to derive the source code of the Services;
- Use the Services for any commercial purpose without our prior written consent;
- Use any content, assets, gameplay, or other materials from the Services as training data or input for any generative artificial intelligence tool, model, or system without our prior written consent;
- Violate any applicable app store terms.
Any violation may result in immediate termination of your license and account, and may subject you to legal action.
10. Disputes Between Users
Lucky Planet Games Inc. is not responsible for disputes, disagreements, or conflicts between users of the Services. If you have a dispute with any other user, you release Lucky Planet Games Inc. and its officers, directors, employees, and agents from all claims, demands, and damages of any kind arising out of or relating to such dispute.
11. User Content
You grant us a worldwide, royalty-free, perpetual, irrevocable license to use any content you submit through the Services.
You are solely responsible for your content.
12. Unsolicited Submissions and Feedback
Lucky Planet Games Inc. does not accept unsolicited submissions of concepts, creative ideas, suggestions, game ideas, scripts, or other creative content. If you send us any unsolicited submission or feedback of any kind (collectively, “Submissions”), you grant Lucky Planet Games Inc. and its affiliates a perpetual, irrevocable, non-exclusive, worldwide, fully sublicensable, transferable, royalty-free right and license to use, reproduce, modify, adapt, publish, and exploit such Submissions in any manner, medium, or form, whether now known or hereafter devised, without restriction or compensation to you. Lucky Planet Games Inc. is under no obligation to keep Submissions confidential, respond to them, or refrain from using any Submission in whole or in part.
13. Intellectual Property
All content, software, and materials in the Services are owned by Lucky Planet Games Inc. or its licensors. You may not copy, modify, distribute, or create derivative works without our prior written permission.
14. Third-Party Links and Services
The Services may contain links to or integrations with third-party websites, services, or content not owned or controlled by Lucky Planet Games Inc. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. We make no representations or warranties regarding any third-party services. Your use of any third-party service is at your own risk and subject to that third party’s own terms and policies.
15. Connectivity and Device Requirements
Certain features of the Services require an active internet connection via Wi-Fi or mobile data. Lucky Planet Games Inc. accepts no responsibility for the Services not functioning if you do not have access to an internet connection.
If you use the Services outside of a Wi-Fi area, your mobile network provider’s terms and data charges will apply. You accept sole responsibility for any such charges, including roaming data charges incurred outside your home territory. If you are not the bill payer for the device, we assume you have obtained permission from the bill payer before using the Services.
Lucky Planet Games Inc. does not guarantee that the Services will always be compatible with your device’s operating system version. We reserve the right to update, change, or discontinue support for specific OS versions or devices at any time without notice or liability.
16. Termination
You may terminate your use of the Services at any time by ceasing all use and deleting the application from your device. To request deletion of your account and associated data, please see our Privacy Policy.
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason. Upon termination, your license ends immediately.
17. Photosensitive Seizure Warning
A small percentage of individuals may experience epileptic seizures or blackouts when exposed to certain flashing lights or light patterns, including those that may appear in our games during win animations, spinning effects, or other visual sequences. If you or anyone in your household has an epileptic condition, consult your physician before using the Services. If you experience dizziness, altered vision, eye or muscle twitching, loss of awareness, disorientation, any involuntary movement, or convulsions while using the Services, discontinue use immediately and consult your physician.
18. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
20. Waiver of Injunctive Relief
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES OR YOUR RELATIONSHIP WITH LUCKY PLANET GAMES INC. MUST BE RESOLVED THROUGH BINDING ARBITRATION OR IN COURT ON AN INDIVIDUAL BASIS FOR MONETARY DAMAGES ONLY. YOU WAIVE ANY RIGHT TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF AGAINST LUCKY PLANET GAMES INC.
21. Indemnification
You agree to indemnify, defend, and hold harmless Lucky Planet Games Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Services or violation of these Terms.
22. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.
Any claim arising out of or relating to these Terms or the Services must be brought within one (1) year of the date the claim arose. Any claim not brought within this period is permanently barred, regardless of any applicable statute of limitations.
Any disputes shall be resolved through binding arbitration administered by the American Arbitration Association in Thousand Oaks, California. Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies under that court’s jurisdictional limits. You waive any right to participate in a class action lawsuit or class-wide arbitration. You may opt out of binding arbitration by notifying us in writing at Privacy@LuckyPlanetGames.com within 30 days of first accepting these Terms. Your notice must include your name and account email or username.
Notwithstanding the foregoing, claims arising out of or relating to the infringement, misappropriation, or violation of intellectual property rights — including copyright, trademark, patent, and trade secret claims — are not subject to arbitration and may be brought in any court of competent jurisdiction. This exclusion applies to claims brought by either party.
If you are located in the European Union, European Economic Area, or United Kingdom, the arbitration and class action waiver provisions above do not apply to you, and you retain the right to bring disputes before the courts of your country of residence.
23. Changes to These Terms
We may update these Terms at any time. Material changes will be reflected by updating the Effective Date. Your continued use of the Services constitutes acceptance of the revised Terms.
24. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable. All remaining provisions will continue in full force and effect.
25. California Notice
Under California Civil Code §1789.3, California residents may report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by writing to 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
